5. ELIGIBILITY: The 2022 Localicious® Sweepstakes (“Sweepstakes”) is open to individuals who are legal U.S. residents, age 21 or older at time of entry. Employees of Sponsor, Administrator, or their respective parent, subsidiary or affiliated companies; or the advertising, promotional or fulfillment agencies of any of them (individually and collectively, “Entities”) are not eligible to enter or win; nor members of their households or immediate families (defined as parent, child, spouse, siblings and the spouses of each). Sweepstakes governed by U.S. law. Sweepstakes is subject to all applicable federal, state and local laws and regulations. Void outside Hawaii and where prohibited by law. 
6. HOW TO ENTER: The Sweepstakes begins September 1, 2022 at 12:00 am HST and ends September 31, 2022 at 11:59 pm HST (the “Sweepstakes Period”). To enter visit localicioushawaii.org (“Website”) and complete a registration form including your name, email, and phone number.  Sponsor is not responsible for entries and images that are incomplete, illegible, lost, late, inaccurate, undelivered, delayed, misdirected, do not adhere to the rules or specifications, or cannot be completed due  to electronic or technical difficulties, regardless of cause. All Entries become the property of Sponsor and will not be acknowledged or returned.
7. PRIZE: One (1) Winner will be randomly selected for two (2) first class roundtrip tickets to anywhere Alaska Airlines flies, two (2) night stay ocean view room at the Royal Sonesta Kauai Resort, two (2) rum tasting on Kauai at the Koloa Rum Tasting Room, $200 Gift Certificate to Keoki’s Paradise, and $250 Gift Card to The Shops at Kukui‘ula. No cash or other prize substitution permitted except at Sponsor’s discretion. The prize is nontransferable. Sponsor is not liable for any technical or logistical issues with Winners’ retrieving the prizes from Sponsor and will not reissue prizes.      Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by winners is Acceptance ofprize constitutes permission for Sponsor to use winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law. Odds of winning depend on number of eligible entries received each day during the Sweepstakes Period.
8. RANDOM DRAWING: Winners will be determined in a random drawing from all eligible entries receiveddaily during Sweepstakes Period by Administrator whose decisions are final and binding in all mattersrelating to this Sweepstakes. Winners will be notified by email by the Winners will be required to sign and return an Affidavit of Eligibility, Liability and Publicity Release (collectively, “Release”) within 48 hours of notification. If a potential prize winner does not acknowledge receiving the notification within 48 hours of its dispatch, or does not return the executed Release within 48 hours, or if said e-mail is returned as undeliverable, or if an entrant is otherwise found to be ineligible, or if the selected winner cannot accept or receive the Prize for any reason, the potential prize winner will forfeit the Prize and an alternate winner will  be selected. The Sponsor reserves the right to modify the notification procedures in connection with the selection of an alternate winner, if any.
9. LIMITATION OF LIABILITY: By entering you agree to release and hold harmless Sponsor, Administrator, and their subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents,successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation,claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) suchentrant’s participation in the sweepstakes and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error which may occur in the administration of the Promotion or the processing of entries; (vi) the creation of an entry including any and all claims for copyright infringement, invasion of privacy, violation of the right of publicity or defamation; (vii) the acceptance, possession, use or misuse of the prize or parts thereof, if applicable, or participation in the Sweepstakes or participation in any Sweepstakes or related activity.

CONDITIONS: By entering this Sweepstakes and/or accepting any prize you may win, you agree that: (i)you have all rights, permissions and consents necessary to grant the rights to Sponsor as expressed herein; (ii) you will abide by and be bound by the Rules and the Sponsor’s/Administrator’s decisions; (iii) the Entry becomes solely the Sponsor’s property and will not be returned; (iv) you release and hold harmless any other Releasees from any and all liability for claims, injuries, losses or damages of any kind, including without limitation, death and bodily injury, resulting, in whole or in part, directly or indirectly, from the awarding, delivery, acceptance, use, misuse, possession, loss or misdirection of any prize; participation in the Sweepstakes or any Sweepstakes-related activity or travel or from any interaction with, or downloading of, computer Sweepstakes information; (v) the prizes are awarded “AS IS” and WITHOUT WARRANTY OFANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose); Releasees do not make any representation, warranty or guarantee, express or implied, relating to the Sweepstakes or Prize; (vi) a winner’s acceptance of the Prize constitutes the grant to Sponsor and assigns of an unconditional right to use winner’s name, address (city and state only), voice, likeness, photograph, biographical and prize information and/or statements about the Sweepstakes for any programming, publicity, advertising and promotional purposes, worldwide, in perpetuity, without additional compensation, except where prohibited by law; (vii) in the event viruses, bugs, unauthorized human intervention, Acts of God, acts or regulations of any governmental or supra-national authority, war, national emergency, accident, fire, riot, strikes, lock-outs, industrial disputes, acts of terrorism or other matters beyond the Administrator’s reasonable control, corrupt, prevent or impair the administration, security, fairness or proper play of the Sweepstakes, so that it cannot be conducted as originally planned, except where prohibited by law, Administrator has the right, in its sole discretion, to modify the Rules or to cancel, modify, terminate or suspend the Sweepstakes; and in such event, to select a winner by such method as Administrator in its solediscretion shall consider equitable and in the event the Trip has already commenced, to terminate the Trip and return the Group to any airport of origin as soon as reasonably possible; (viii) the Releasees are notresponsible for typographical or other errors in the offer or administration of this Sweepstakes, including but not limited to: errors in the advertising, Rules, selection and announcement of the winner and distribution of the prize; (ix) any portion of any prize not accepted or used by a winner will be forfeited; (x) the Releasees are not responsible for any inability of a winner to accept or use the prize (or any portion thereof) for any reason; (xi) the Administrator has the right, at any time and at its sole discretion, to disqualify any individual it suspects to be doing any of the following: (a) tampering or attempting to tamper with the entry process or the operation of the Sweepstakes or the Website; (b) violating the Rules; (c) violating the terms of service, privacy policy or other terms, conditions of use and/or general rules or guidelines of any Sweepstakes property or service; (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person or (e) for any other good cause as determined solely by the Administrator; (xii) Administrator has the right to lock out an entrant whose eligibility is in question or who has been disqualified or is otherwise ineligible to enter the Sweepstakes; (xiii) since any attempt by any individual to damage the Website or undermine the legitimate operation of this Sweepstakes or the Website is a violation of these Rules as well as criminal and civil laws, and should Administrator believe or become aware that such an attempt has been, is being, or will be made, it has the right to seek remedies and damages from any responsible individuals to the fullest extent permitted by law, including without limitation criminal prosecution; (xiv) all disputes, claims and causes of action at law or in equity (individually, “Claim”) arising out of or relating to this Sweepstakes, the meaning or interpretation of the Rules or any prize awarded shall be resolved by applying the laws of Hawaii, without regard to conflict of laws provisions therein, and shall be solely and exclusively brought in the state or federal courts within that state; (xv) all Claims shall be resolved individually, without resort to any form of class action; (xvi) all Claims, judgments and awards shall belimited to actual out-of-pocket costs incurred, but in no event include attorneys’ fees, and under no circumstances will any entrant be permitted to obtain awards for, and hereby waives all rights to claim, punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses and waives all rights to have damages multiplied or otherwise increased; (xvii)Administrator has the right to modify prize award procedures at its sole discretion;
11. PRIVACY: By entering, the information entrants provide will not be sold or shared with Sponsor partners or any 3rd party, but winner’s email addresses may be included in Sponsor’s mailing list to receive periodic email newsletter updates.
